Esta es la primera parte de una serie de varias partes que se trata de qué se debería hacer si se resultó herido en un accidente laboral.

 

 

Parte 1: Archivación

Los accidentes laborales llegan de la nada. Ponen presiones emocionales y financieras sobre el trabajador herido y sobre su familia. Si ha estado herido, fisicamente restringido, o despedido de su empleo debido a un daño laboral, debería conseguir beneficios disponibles bajo las leyes de compensación de trabajadores. Aunque cada caso sea distinto, los siguientes consejos le pueden ayudar. Aquí le entregamos pasos generales que puede tomar hacia la exitosa búsqueda de un caso de compensación de trabajadores.

Paso 1: Anotar el accidente

Sobre todo, ¡lo importante es informar a su supervisor de su accidente o herida! Siempre que tenga un accidente laboral en que se resulte herido, anote los detalles del incidente mientras los tenga bien claros. Debería incluir la hora, fecha, lugar, y circunstancias del incidente y la información de contacto de todas las personas involucradas y de los testigos. Su informe constituye la base de su caso legal.

Paso 2: Obtener su ficha personal

Obtenga una copia de su ficha personal en el departamento de recursos humanos lo antes posible. Su ficha personal – archivos de anteriores menciones y reprimendas, recibos de pago, revistas anuales, y otros datos empresariales – contiene información clave acerca de su historia en la compañía. Guarde una copia impresa del desarrollo de su trabajo, especialmente lo relacionado a su accidente.

Paso 3: Guardar talones de pago y otros archivos de su empleador

Guarde los manuales de empleados, talones de pago, y cualquier mensaje que su empresa le mande. Estos archivos ayudarán a su abogado a establecer cuál era su salario en el momento de su accidente, sus derechos y sus responsabilidades.
