Woman can proceed with lawsuit against city for car accident

On June 23, it was reported that a Nebraska woman who suffered a life-altering injury was given permission by the Nebraska Supreme Court to proceed with a lawsuit that she had previously filed against Adams County and the City of Hastings. he lawsuit, filed in 2011, was based on an accident that had occurred in 2009.

A state patrol officer reportedly alerted the city to a corn mash spill that took place on Nov. 15, 2009. The spilled mash was moved off the road and onto the shoulder by local firefighters prior to the reopening of the road. The following day, the woman and her husband were involved in a car accident that was potentially caused by a slick road. The lawsuit reportedly claimed that the corn mash spill was not properly cleaned, causing the accident. The accident caused the woman’s arm to be partially amputated. The Supreme Court’s ruling essentially allowed the couple to seek compensation from the county and from the city for their injuries.

Those who are involved in auto accidents caused by the negligence of another party can potentially seek compensation for a variety of damages. In many cases, the victim will seek the cost of their medical bills and compensation for wages lost due to an inability to return to work.

In some cases, an attorney may assist with demonstrating that the plaintiff suffered serious noneconomic damages as well. They may include physical pain and suffering, loss of enjoyment of life and mental distress. The person’s spouse may also seek compensation for loss of consortium.
